Expungement Legislation Act

Introduction and Purpose

The purpose of this Act is to provide citizens of the State of San Andreas with an opportunity for rehabilitation and a second chance at a clean record. Through judicial oversight, eligible individuals may remove prior criminal conduct from their record and work towards a law-abiding future.

Constitutional Justification

Under Article III - Rights and Freedoms of the Constitution of San Andreas, all citizens are guaranteed the Right to Information and the Right to Due Process. The ability to review and remove charges from one’s record with appropriate judicial supervision upholds these rights and promotes fairness within the justice system.

Article I - Implementation Plan

The San Andreas Department of Justice (DOJ) shall be responsible for administering the expungement process.

A Judge or Justice may oversee and approve expungement applications when the following conditions are met:

  • The applicant has remained crime-free for a minimum of thirty (30) days prior to filing.

This means the applicant must not have been arrested or charged with any misdemeanour or felonies within that period.

Traffic citations are exempt from this restriction.

  • The applicant pays the applicable expungement fee in full.
  • Each subsequent expungement request will incur an escalating fee as set forth in Article II.

Article II - Chagge and Charges Ineligible for Expungement

The initial expungement request shall cost $50,000. Each additional expungement thereafter will triple (3x) in cost.

HUT charges as denotes in the Due Process and Jurisprudence Act, are not eligable for expungement.

Article III - Administrative Recordkeeping and Notification

  1. Upon completion of an expungement, the presiding Judge or Justice must ensure the following administrative actions are taken:
    • A note shall be placed on the individual’s MDT profile, clearly stating:
      • The name of the Judge or Justice who authorised the expungement;
      • The date of approval; and
      • The total amount paid for the expungement.
  2. The DOJ shall maintain an internal log of all expungements for audit and verification purposes.
  3. Any unauthorised removal or concealment of records prior to proper expungement shall be considered tampering with state records and may result in criminal action.

Conclusion

The Expungement Legislation Act provides citizens with a structured process for redemption while preserving judicial integrity and public safety. By affording a fair opportunity for rehabilitation, this Act strengthens the justice system’s commitment to reform and equality before the law.
