Alcohol Control & Licensing Act (ACLA)


1. Purpose & Intent

The Alcohol Control & Licensing Act (ACLA) establishes a comprehensive legal framework governing the sale, service, distribution, and consumption of alcoholic beverages within the State of San Andreas.

The objectives of this Act are to:

  • Promote public safety and responsible alcohol service
  • Prevent alcohol-related crime, disorder, and public nuisance
  • Establish clear licensing authority and enforcement powers
  • Regulate commercial venues and private events consistently

2. Definitions

For the purposes of this Act, the following definitions apply:

  • Alcoholic Beverage
    Any beverage containing more than 0.5% alcohol by volume (ABV).

  • Licensed Premises
    Any location authorised to sell or serve alcoholic beverages under this Act.

  • License Holder
    Any individual, partnership, or business entity issued an alcohol license.

  • Responsible Person
    The owner, manager, or designated supervisor responsible for alcohol service and compliance at a licensed premises.

  • Private Event
    A non-public gathering where alcohol is provided, with or without sale.

  • Intoxicated Person
    Any individual who appears impaired by alcohol to a degree that poses a risk to themselves or others.

For the purposes of this Act, the legal age to purchase, possess, or consume alcoholic beverages is twenty-one (21) years of age.

No person under the age of twenty-one (21) may be sold, served, furnished, or provided alcohol under any circumstances, except where expressly authorised by law.


3. Licensing Authority

3.1 Governing Authority

Alcohol licensing authority is vested in the Department of Justice (DOJ) or a designated Business & Licensing Board.

3.2 Authority & Powers

The Licensing Authority may:

  • Issue, renew, suspend, or revoke alcohol licenses
  • Impose operational conditions or restrictions
  • Conduct inspections and compliance audits
  • Refer violations for criminal or civil enforcement

4. License Categories

4.1 On-Premises Consumption License

Authorises the sale and service of alcohol for consumption on the licensed premises, including:

  • Bars
  • Nightclubs
  • Pubs
  • Restaurants

4.2 Off-Premises Sales License

Authorises the sale of sealed alcoholic beverages for consumption off-site, including:

  • Liquor stores
  • Convenience stores

4.3 Temporary Event License

Authorises alcohol service at specific, time-limited events, including:

  • Festivals
  • Weddings
  • Corporate functions
  • Private hire events

4.4 Private Host Permit

Authorises the provision of alcohol without commercial sale at private residences or invite-only events.


5. Licensing Requirements

Applicants for an alcohol license must:

  • Hold valid business registration where applicable
  • Appoint a Responsible Person for each operating period
  • Agree to inspections and compliance checks
  • Maintain order, safety, and crowd control
  • Comply with all conditions imposed by the Licensing Authority

6. Operational Obligations

6.1 Age Restrictions

Alcoholic beverages may not be sold, served, or provided to persons under the legal drinking age.

6.2 Service Restrictions

License holders and staff must:

  • Refuse service to intoxicated persons
  • Take reasonable steps to prevent disorderly or violent conduct
  • Comply with lawful orders to suspend or cease alcohol service

6.3 Hours of Operation

The Licensing Authority may:

  • Establish standard operating hours
  • Grant extended service hours by special permission
  • Impose mandatory closing periods where required for public safety

7. Prohibited Conduct

It is unlawful for any person or license holder to:

  • Sell or provide alcohol without a valid license or permit
  • Serve alcohol to intoxicated persons
  • Permit violent, disorderly, or unsafe conduct
  • Operate outside approved hours
  • Breach or tamper with licensing conditions

8. Enforcement Authority

The following agencies are authorised to enforce this Act:

  • State Police
  • Local Police Departments
  • Designated Licensing Inspectors
  • DOJ Investigative Units

Authorised officers may:

  • Enter and inspect licensed premises
  • Issue warnings or citations
  • Order the immediate cessation of alcohol service
  • Detain individuals where lawful authority exists

9. Penalties & Sanctions

9.1 Administrative Sanctions

The Licensing Authority may impose:

  • Written warnings
  • Monetary fines
  • Temporary suspension of license
  • Permanent revocation of license

9.2 Criminal Liability

Serious or repeated violations may result in:

  • Criminal charges
  • Court-ordered business closure
  • Disqualification from future alcohol licensing

10. Private Events & Social Hosts

10.1 Host Responsibilities

Private hosts must:

  • Prevent underage consumption
  • Take reasonable steps to prevent excessive intoxication
  • Maintain control of guests and the event environment

10.2 Host Liability

Hosts may be held liable for:

  • Alcohol-related injuries or harm
  • Disorderly conduct resulting from the event
  • Failure to take reasonable preventative measures

11. Appeals & Review

Any person or entity subject to:

  • License denial
  • Suspension
  • Revocation

may file an appeal with the Department of Justice or designated review body within the prescribed time period.


12. Relation to Other Laws

This Act operates in conjunction with:

  • Public Order statutes
  • Driving Under the Influence (DUI) laws
  • Business licensing and taxation laws

Nothing in this Act limits the enforcement of any other applicable law.
