Weapons & Drivers License Legislation Act (W&DLLA)

State of San Andreas – State Register of Laws

Legislated by the Department of Justice (DOJ). Enforced by all State and Local Law Enforcement Agencies.


Introduction

This Act establishes the regulatory framework governing the lawful ownership and operation of firearms and motor vehicles within the State of San Andreas.
It ensures public safety while preserving the constitutional right of citizens to defend themselves and others against unlawful harm.


Constitutional Justification

Under Article III – Rights and Freedoms of the Constitution of San Andreas, citizens have the right to protect themselves and others within reason.
The controlled issuance of weapons licenses allows responsible citizens to exercise this right while maintaining public order and safety.


Article I – Permitted Firearms
  • The only firearm permitted under this licence is the M1911, which must be purchased from Ammu-Nation.
  • Ownership or possession of any other firearm is prohibited under this licence.
  • Possession of any unauthorised firearm constitutes Criminal Possession of a Class 1 Firearm under Title 12 of the Penal Code.

Note: This Act operates as Schedule I under the Firearms Control and Licensing Act (FCLA) for Class 1 civilian firearm regulation.


Article II – Licence Conditions

Eligibility Requirements

Applicants must:

  • Have no felony convictions.
  • Pass a background check conducted by the Department of Justice or a delegated law enforcement agency.

Conditions of Licence

  • The licence permits possession and lawful use of the M1911 only.
  • A valid licence must be presented on demand to law enforcement.
  • The licence is non-transferable and subject to annual review.

Article III – Application Process

Applicants must:

  1. Provide proof of identity (State ID or equivalent).
  2. Pay a $25,000 licensing fee to the San Andreas Department of Justice.
  3. Submit to DNA collection by a Law Enforcement Officer, which shall be recorded in their MDT profile.

Once complete, the DOJ shall conduct the background investigation and issue a determination within a reasonable period.


Article IV – Approval and Issuance

Upon successful review of the application and background check, a Weapons Licence may be issued by a Clerk, Judge, or Justice of the Department of Justice.

The applicant must demonstrate satisfactory understanding of:

  • The charge of Criminally Negligent Ownership of a Firearm; and
  • The principles of the Stand Your Ground Doctrine.

    Licences shall be recorded in the DOJ registry and visible to law enforcement MDT systems.

Article V – Usage Restrictions
  • The M1911 may only be used for self-defence or lawful recreational shooting.
  • The firearm may not be modified in any way.
  • The registered owner may possess only one registered firearm at any given time, whether on their person or in storage.
  • Each additional registered firearm constitutes Criminal Possession of a Class 1 Firearm, and the licence shall be revoked.

Article VI – Law Enforcement Exemptions

Law Enforcement Officers may be issued a Weapons Licence permitting the use of approved police-issued firearms as part of their duties.

Police-Issued Firearms Include:

  • Firearms obtained from the Law Enforcement Armory
  • Department-issued sidearms and rifles approved under agency SOP

This exemption does not apply off-duty.
Officers wishing to carry a personal M1911 while off-duty must obtain a separate Weapons Licence under this Act.

This exemption extends to magazines, attachments, and ammunition associated with issued firearms.


Article VII – Prohibited Actions
  • Ownership or possession of any firearm other than the M1911 is illegal.
  • Using a firearm for unlawful purposes (e.g. threats, assaults) results in immediate licence revocation and criminal charges.
  • Selling, transferring, or gifting a registered firearm is prohibited.
  • Falsely reporting a firearm as stolen constitutes False Reporting and Criminally Negligent Ownership of a Firearm, resulting in immediate licence revocation without reimbursement.
  • Straw purchasing (buying for another person) will result in immediate licence revocation and accessory charges.

Article VIII – Class 2 and Class 3 Weapons

The Weapons Licence does not authorise the possession or use of Class 2 or Class 3 weapons.

Possession or use of Class 2 or Class 3 weapons is punishable under Title 12 – Firearms & Weapons Offences.


Article IX – Revocation of Weapons Licence

A Weapons Licence shall be revoked if the holder:

  • Is convicted of a violent felony or violent misdemeanor.
  • Is convicted of Criminally Negligent Ownership of a Firearm.
  • Violates any Prohibited Action listed in Article VII.

    A Judge or Justice may revoke a licence if there is sufficient probable cause that the licensee has committed a violent offence.

    Any Law Enforcement Officer removing a citizen’s licence must record on the MDT:
  • The incident number,
  • The officer’s name, and
  • The date of removal.

Article X – Drivers Licence Regulations

These provisions govern the issuance and regulation of Drivers Licences within San Andreas.

  • Upon accumulation of 20 points, a citizen’s licence shall be suspended.
  • The suspension shall be enacted by the officer issuing the fine that caused the total to exceed 20 points.
  • Points expire on a rolling basis from the date of issue.
  • Reinstatement requires consultation with a County Clerk, Judge, or Justice of the DOJ and payment of a $500 service fee.

Conclusion

This Act provides a clear and balanced framework allowing citizens to exercise their right to self-defence responsibly, while ensuring that weapons and motor vehicles are regulated for the protection of all.
It forms Schedule I under the Firearms Control and Licensing Act (FCLA) for civilian licensing and use of Class 1 firearms.
