Constitution of the State of San Andreas
Preamble
We, the people of San Andreas, in order to build a just and unified community, establish justice, maintain domestic tranquillity, provide for our collective defence, promote the general welfare, and secure the blessings of liberty for ourselves and future generations, do hereby ordain and establish this Constitution for the State of San Andreas.
Article I - Governance and the Rule of Law
Supremacy of the Constitution This Constitution is the supreme law of San Andreas. All persons and institutions are bound by it.
Obligation of Obedience Every citizen shall uphold and respect the principles, rights, and duties enshrined in this Constitution and the laws enacted under it.
Civic Duties Citizens are required to contribute to the State through lawful means, including the payment of taxes and participation in civic processes.
Article II - Legislative and Administrative Authorities
Section 1 - The Department of Justice (DOJ)
The San Andreas Department of Justice shall hold supreme legislative and judicial authority within the State. It is responsible for ensuring the fair enforcement of law, the preservation of justice, and the protection of citizens’ rights and liberties. Precedents set by Justices shall form the Common Law of San Andreas. The DOJ shall also safeguard the State’s integrity, uphold this Constitution, and administer elections, referendums, and public appointments.
Section 2 - Law Enforcement Oversight
The Department of Justice (DOJ) shall exercise supreme oversight and authority over all Law Enforcement Agencies operating within the State of San Andreas. These agencies shall act under the law, the Constitution, and any statutes or directives issued by the DOJ.
- The DOJ shall be responsible for maintaining the integrity, accountability, and coordination of all Law Enforcement operations throughout the State.
- The structure, powers, jurisdictions, and administrative leadership of Law Enforcement Agencies shall be defined by legislation enacted or approved by the DOJ.
- All Law Enforcement personnel are recognised as agents of the State, bound by the Constitution and subject to judicial oversight.
- The DOJ retains full authority to investigate, reform, or dissolve any agency or division found to be in violation of constitutional or statutory law.
- In the event of conflict or uncertainty between agencies, the Department of Justice shall serve as the final arbiter of jurisdiction and conduct.
Section 3 - San Andreas Medical Authority (SAMA)
- The San Andreas Medical Authority shall oversee healthcare standards and legislation within the State.
- A single active medical professional shall be elected to serve as Director of SAMA, representing all medical services.
- The Director of SAMA shall be appointed through a panel of sitting Justices and must be elected by a majority vote.
- The Authority shall consist solely of practising medical professionals from the Los Santos Medical Group or the Emergency Medical Services.
- SAMA shall ensure fair representation across all medical factions and provide guidance on public health law, emergency care, and medical ethics.
Section 4 - Jurisdictional Boundaries
The defined jurisdictions of Los Santos County are outlined on the official State Map.
- Waters and islands surrounding the mainland are under shared State jurisdiction.
- Airspace up to ten miles above land shall fall under the jurisdiction of the area below. Any airspace above this limit shall fall under the direct authority of the State of San Andreas.
- Any unassigned or undiscovered territory shall be deemed property of the State of San Andreas, with all law enforcement agencies possessing equal jurisdiction therein.
- Newly discovered or unincorporated lands within twenty miles of the coastline shall automatically fall under State jurisdiction until otherwise designated by law.
Article III - Rights and Freedoms
Right to Assemble
Citizens have the right to peaceful assembly, provided such actions do not infringe upon the rights or safety of others.
Right to Free Speech and Expression
Citizens may freely express their opinions, beliefs, and thoughts without censorship, coercion, or reprisal.
Right to Dignity
Every individual shall be treated equally, free from discrimination, and with respect under the law.
Right to Information
Citizens have access to public information necessary for personal and collective welfare.
Right to Petition and Vote
Citizens may submit grievances, petitions, and proposals to their government and participate in free and fair elections.
Right to Fair Trial and Due Process
Every citizen shall receive a fair trial and full due process of law.
Right to Privacy
Citizens are entitled to personal privacy and protection from unlawful intrusion or disclosure.
Right to Health and Protection of Others
Citizens have access to essential healthcare and may act reasonably in defence of themselves and others.
Right to Property
Citizens have the right to own property and possessions, subject to lawful limitations to prevent infringement upon others’ rights.
Article IV - Social and Civil Services
Right to Healthcare
All citizens are entitled to basic and emergency healthcare.
Right to Housing
Citizens are entitled to access State-provided housing where available, beginning with subsidised apartments within Los Santos.
Right to Bear Arms
Citizens holding a valid firearm licence may possess and carry firearms. Melee weapons require no licence.
Article V - Amendments and Interpretation
1. Amendments to the Constitution
Amendments to this Constitution may be proposed by any sitting Justice of the Department of Justice.
- Proposed amendments require majority approval by the active Justices of the State of San Andreas.
- Upon approval, the amendment shall be published publicly and recorded within the State Register of Laws.
- Amendments shall take effect immediately unless otherwise specified within the amendment text.
2. Judicial Interpretation
The Department of Justice, through its Justices, holds sole authority to interpret the meaning and scope of this Constitution.
- Judicial interpretation shall serve as binding precedent for all future cases and legislation.
- Where ambiguity exists, the interpretation most consistent with justice, liberty, and the public good shall prevail.
3. Supremacy of Constitutional Law
Any statute, ordinance, or policy in conflict with this Constitution shall be rendered null and void.
4. Public Access and TransparencyAll constitutional amendments and judicial interpretations shall be made publicly available through official State publication channels to ensure transparency and civic awareness.
Ratification and Signatories
This Constitution is hereby ratified and enacted by the State of San Andreas as of 17th October 2025.
